I am able to provide specialist anaesthetic medicolegal services relating to liability and causation, coronial inquests and professional registration hearings
In addition to full reports, I am able to offer fixed-fee preliminary or screening reports (including perusal of the medical notes and an opinion as to whether there has been a Breach of Duty) within five weeks of receipt of records. The current turn-around time for standard reports is 12 weeks from receipt of records but “fast-track” reports can be expedited where required, subject to an uplifted fee.
Case Reviews, Preliminary / Screening Reports
I will review the medical records and provide an overview of the particular case. This review will give the instructing solicitors guidance in assessing the merits of the case. Each review will come with a recommendation:
- No case to answer or
- Clear evidence suggesting failure of duty of care or
- Insufficient information to arrive at a safe conclusion, recommend more detailed analysis
Liability & Causation Reports
A full and detailed Liability and Causation report will be prepared to comply with Part 35 CPR (or equivalent for other jurisdictions) and suitable for disclosure. Each report contains:
- A truncated CV (full CV available to download)
- A list of documents from which the report was prepared
- A relevant past medical history of the Claimant/Defendant
- A full chronology of events leading up to and including the event in question
- A detailed and logically ordered opinion
- A final summary of conclusions
The cost of this report will be based on an hourly fee rate of £270 per hour (as of January 2021) with fees ranging from £1100 – £2000 depending on the amount of work involved. On receipt of the initial documents I will be able to give a more precise fee estimate. Completion of these reports is usually within 12 weeks of receiving the documentation and authorisation to proceed but cases can be fast tracked after individual discussion.
Experience
I practiced as a consultant anaesthetist in the NHS for 32 years, retiring from active duty at the end of July 2020. I remain on the GMC register and am able to report on matters which occurred during the period when I was in practice (1989-2020).
I worked in all areas of anaesthesia except for cardiac, thoracic, neurosurgery, paediatrics and Intensive Care. My specialist interest is obstetrics, and I have written widely on issues relating to consent, capacity, safety and human factors.
I have served as the President of the Obstetric Anaesthetists’ Association, the Vice-President of the Association of Anaesthetists of Great Britain and Ireland, and an elected Council member of the Royal College of Anaesthetists. I was the Editor-in-Chief of the journal Anaesthesia. I have a Masters degree in Medical Law (LLM) and have served as Deputy Coroner to Cardiff and the Vale of Glamorgan. I currently chair the Ethics Committee of the Royal College of Anaesthetists.
I have delivered many lectures and teaching sessions internationally, often as a keynote speaker (details on CV). I have also lectured to solicitors and barristers in London and elsewhere.
My Claimant to Defendant ratio is approximately 4:1. I have provided over 800 reports relating to claims for negligence, as well as advising and giving evidence in coronial, criminal and GMC proceedings.
